COUNCIL DECISION (EU) 2024/1303
of 29 April 2024
on the conclusion, on behalf of the Union, of the Protocol amending the Agreement between the European Union and Japan for an Economic Partnership
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 207(4), first subparagraph, in conjunction with Article 218(6), second subparagraph, point (a)(v), thereof,
Having regard to the proposal from the European Commission,
Having regard to the consent of the European Parliament (1),
Whereas:

In accordance with Council Decision (EU) 2024/578 (2), the Protocol amending the Agreement between European Union and Japan for an Economic Partnership (‘the Protocol’) as regards the free flow of data was signed on 31 January 2024, subject to its conclusion at a later date. |

The European Data Protection Supervisor was consulted in accordance with Article 42(1) of Regulation (EU) 2018/1725 of the European Parliament and of the Council (3) and delivered its opinion 3/2024 on 10 January 2024. |

The Protocol should be approved on behalf of the Union, |
HAS ADOPTED THIS DECISION:
Article 1
The Protocol amending the Agreement between the European Union and Japan for an Economic Partnership is hereby approved on behalf of the Union (4).
Article 2
The President of the Council shall, on behalf of the Union, give the notification provided for in Article 23.2 of the Agreement between the European Union and Japan for an Economic Partnership, in order to express the consent of the Union to be bound by the Protocol (5).
Article 3
This Decision shall enter into force on the date of its adoption.
