COUNCIL DECISION (EU) 2022/1677

of 26 September 2022

on the position to be taken on behalf of the European Union within the Joint Committee established by the Agreement between the European Union and the Government of the People’s Republic of China on cooperation on, and protection of, geographical indications as regards the adoption of the rules of procedure of the Joint Committee

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 207(4), first subparagraph, in conjunction with Article 218(9) thereof,

Having regard to the proposal from the European Commission,

Whereas:

 

(1)

The Agreement between the European Union and the Government of the People’s Republic of China on cooperation on, and protection of, geographical indications (1) (‘the Agreement’) was concluded by Council Decision (EU) 2020/1832 (2) and entered into force on 1 March 2021.

 

(2)

Pursuant to Article 10 of the Agreement, the Joint Committee is to determine its own rules of procedure.

 

(3)

It is appropriate to establish the position to be taken on the Union’s behalf in the Joint Committee, with regard to its rules of procedure, as those rules will be binding on the Union.

 

(4)

To ensure the effective implementation of the Agreement, the rules of procedure of the Joint Committee should be adopted.

 

(5)

The position of the Union within the Joint Committee should therefore be based on the attached draft Decision,

HAS ADOPTED THIS DECISION:

Article 1

The position to be taken on the Union’s behalf within the Joint Committee established by the Agreement between the European Union and the Government of the People’s Republic of China on cooperation on, and protection of, geographical indications as regards the adoption of its rules of procedure shall be based on the draft Decision of the Joint Committee attached to this Decision.

Article 2

This Decision shall enter into force on the date of its adoption.

THE JOINT COMMITTEE,

Having regard to the Agreement between the European Union and the Government of the People’s Republic of China on cooperation on, and protection of, geographical indications (1), and in particular Article 10 thereof,

Whereas:

 

(1)

The Agreement between the European Union and the Government of the People’s Republic of China on cooperation on, and protection of, geographical indications (‘the Agreement’) was concluded by the Union by Council Decision (EU) 2020/1832 (2) and entered into force on 1 March 2021.

 

(2)

Pursuant to Article 10 of the Agreement, the Joint Committee is to determine its own rules of procedure.

 

(3)

To ensure the effective implementation of the Agreement, the rules of procedure of the Joint Committee should be adopted,

HAS ADOPTED THIS DECISION:

Article 1

The rules of procedure of the Joint Committee, as set out in the Annex to this Decision, are hereby adopted.

Article 2

This Decision shall enter into force on the date of its adoption.
