Subject: Proposal for a Regulation of the European Parliament and of the Council amending Regulation (EC) No 1393/2007 i of the European Parliament and of the Council on the service in the Member States of judicial and

extrajudicial documents in civil or commercial matters (service of documents) - Optional consultation of the Committee of the Regions

  • 1. 
    On 31 May 2018, the Commission submitted to the Council a proposal for a Regulation of the European Parliament and of the Council amending Regulation (EC) No 1393/2007 i of the

    European Parliament and of the Council on the service in the Member States of judicial and extrajudicial documents in civil or commercial matters (service of documents).

  • 2. 
    In its proposal, the Commission suggests that the European Economic and Social Committee (EESC) and the Committee of the Regions (CoR) be consulted on an optional basis.
  • 3. 
    Article 81 of the Treaty on the Functioning of the European Union (TFEU), on which the proposal is based, does not require the opinion of the EESC or that of the CoR.
  • 4. 
    The EESC will issue an opinion on its own initiative by October 2018 in accordance with

    Article 304 TFEU.

  • 5. 
    Given the subject matter of the proposal and its cross-border judicial cooperation aspects, it is considered appropriate to follow the suggestion of the Commission and that the Council

    consults the CoR on an optional basis.

  • 6. 
    The Permanent Representatives Committee is therefore invited to decide, in accordance with Article 307 TFEU and Article 19(7)(h) of the Council's Rules of Procedure, to consult the

    CoR on the abovementioned proposal and to request them to give their opinion as soon as possible.
