Mission: The mandate of the expert group is related to the adoption of delegated acts for the scheduling of new psychoactive substances. These scheduling decisions are based on the risk assessments carried out by the European Monitoring Centre for Drugs and Drug Addiction (EMCDDA). The expert group will be called upon by the Commission for the consultation on delegated acts regarding the scheduling of new psychoactive substances, including as regards the transitional provisions (Article 3 of Directive (EU) 2017/2103). In addition, the expert group may also assist the Commission in other ways in relation to the implementation of the legislation on new psychoactive substances. The latter would be ad hoc tasks which could be requested from the expert group.

Activity report: The inaugural meeting of the expert group was held on 16 October 2018. Since then, the expert group has been consulted multiple times on draft delegated acts.

Selection procedure: The members of the expert group would be - in line with Articles 1(3) and 3 of Directive (EU) 2017/2103 - experts designated by the Member States (so-called "D members"). In addition, the European Monitoring Centre for Drugs and Drug Addiction (EMCDDA), Europol, the European Medicines Agency (EMA), the European Chemical Agency (ECHA), the European Centre for Disease Prevention and Control (ECDC) and the European Food Safety Agency (EFSA) will be invited as so-called E-members.

Rules of procedure: The Rules of Procedure have been adopted at the first meeting of the expert group on 16 October 2018.
