INFORMATION NOTE from: Council Legal Service to: COREPER (2nd part) Subject: Cases before the EU General Court

  • Case T-57/12 (Good Luck Shipping LLC v. Council of the European Union)
  • 1. 
    By applications notified to the Council on 26 March 2012, the above-mentioned company has

    brought an action pursuant to Articles 263 TFEU for the annulment of:

  • Council Decision 2011/783 i/CFSP of 1 December 2011 amending Decision

    2010/413/CFSP concerning restrictive measures against Iran, and

implementing Regulation (EU) No 961/2010 i of 25 October 2010 on restrictive

measures against Iran,

in so far as they concern the Applicant.

  • 2. 
    The Applicant alleges the following grounds in support of his claim:
    • the Council has failed to give adequate or sufficient reasons; - the Council has failed to fulfil the criteria for listing, and/or committed a manifest error

      of assessment;

  • the Council has failed to safeguard the Applicant’s right of defence and right to

    effective judicial review;

  • the Council has infringed, without justification or proportion, the Applicant’s

fundamental rights, including its right to protection of its property, business and

reputation.

  • 3. 
    The Director-General of the Council Legal Service has appointed Mr Vincent PIESSEVAUX

    and Mr Bart DRIESSEN, members of the Legal Service, as the Council’s agents in the case.
