- 15.Calculation based on Member States reporting as regard shipments of hazardous waste for the years 1997-1999. Approximately 15% are between and from EFTA countries and Member States and approximately 7% are between OECD and Member States and other countries.
- 16.It can be debated, if the requirement that waste listed in Annex III shall be accompanied by certain information is a procedural requirement or not. However, since the OECD Decision uses the terminology 'green control procedure' in relation to shipments of waste listed in Annex III (Appendix 3 of the 2001 OECD Decision) and since it is clearer from a descriptive point of view if it is referred to as a procedure, it is considered appropriate to use a 'procedure-terminology' in relation to this information requirement. In certain contexts the term 'normal commercial transaction' is used.

- 162.Namely the following:
- 163.This list originates from the OECD Decision, Appendix 3.
- 164.OJ L 377, 31.12.1991, p. 20
- 165.Annex IX of the Basel Convention is listed in this Regulation in Annex V, Part 1, List B.
- 166.'Non-dispersible' does not include any wastes in the form of powder, sludge, dust or solid items containing encased hazardous waste
- 167.This list originates from the OECD Decision, Appendix 4.
- 168.Annex VIII of the Basel Convention is listed in this Regulation in Annex V, Part 1, List A.
- 169.COM(1990) 415 final, 26 October 1990.
- 170.Note that mirror entry on list B (B1160) does not specify exceptions.
- 171.This entry does not include scrap assemblies from electric power generation.
- 172.PCBs are at a contration level of 50 mg/kg or more.
- 173.The 50 mg/kg level is considered to be an internationally practical level for all wastes. However, many individual countries have established lower regulatory levels (e.g. 20 mg/kg) for specific wastes.
- 174.'Out-dated' means unused within the period recommended by the manufacturer.
- 175.This entry does not include wood treated with wood-preserving chemicals.
- 176.'Out-dated' means unused within the period recommended by the manufacturer.
- 177.Note that even where low level contamination with Annex I materials initially exists, subsequent processes, including recycling processes, may result in separated fractions containing significantly enhanced concentrations of those Annex I materials.
- 178.The status of zinc ash is currently under review and there is a recommendation with United Nations Conference on Trade and Development (UNCTAD) that zinc ashes should not be dangerous goods.
- 179.This entry does not include scrap from electrical power generation.
- 180.Re-use can include repair, refurbishment or upgrading, but not major reassembly.
- 181.In some countries these materials destined for direct re-use are not considered wastes.
- 182.It is understood that such scraps are completely polymerized.
- 183.- Post-consumer wastes are excluded from this entry
- 184.When identifying a waste in the list below, the introduction to the Annex of Commission Decision 2000/532/EC as amended is relevant.
- 185.For the purpose of this list of wastes, PCBs will be defined as in Directive 96/59/EC
- 186.hazardous components from electrical and electronic equipment may include accumulators and batteries mentioned in 16 06 and marked as hazardous; mercury switches, glass from cathode ray tubes and other activated glass etc.
- 187.For the purpose of this entry, transition metals are: Scandium, Vanadium, Manganese, Cobalt, Copper, Yttrium, Niobium, Hafnium, Tungsten, Titanium, Chromium, Iron, Nickel, Zinc, Zirconium, Molybdenum and Tantalum. These metals or their compounds are dangerous if they are classified as dangerous substances. The classification of dangerous substances shall determine which among those transition metals and which transition metal compounds are hazardous.
- 188.Stabilisation processes change the dangerousness of the constituents in the waste and thus transform hazardous waste into non hazardous waste. Solidification processes only change the physical state of the waste (e.g. liquid into solid) by using additives without changing the chemical properties of the waste.
- 189.A waste is considered as partly stabilised if after the stalibisation process dangerous constituents which have not been changed completely into non dangerous constituents could be released into the environment in short, middle or long term.
- 190.Hazardous components from electrical and electronic equipment may include accumulators and batteries mentioned in 16 06 and marked as hazardous; mercury switches, glass from cathode ray tubes and other activated glass etc.

- 208.Calculation based on Member States reporting as regard shipments of hazardous waste for the years 1997-1999. Approximately 15% are between and from EFTA countries and Member States and approximately 7% are between OECD and Member States and other countries.
- 209.It can be debated, if the requirement that waste listed in Annex III shall be accompanied by certain information is a procedural requirement or not.

- 355.Namely the following:
- 356.This list originates from the OECD Decision, Appendix 3.
- 357.OJ L 377, 31.12.1991, p. 20
- 358.Annex IX of the Basel Convention is listed in this Regulation in Annex V, Part 1, List B.
- 359.'Non-dispersible' does not include any wastes in the form of powder, sludge, dust or solid items containing encased hazardous waste
- 360.This list originates from the OECD Decision, Appendix 4.
- 361.Annex VIII of the Basel Convention is listed in this Regulation in Annex V, Part 1, List A.
- 362.COM(1990) 415 final, 26 October 1990.
- 363.Note that mirror entry on list B (B1160) does not specify exceptions.
- 364.This entry does not include scrap assemblies from electric power generation.
- 365.PCBs are at a contration level of 50 mg/kg or more.
- 366.The 50 mg/kg level is considered to be an internationally practical level for all wastes. However, many individual countries have established lower regulatory levels (e.g. 20 mg/kg) for specific wastes.
- 367.'Out-dated' means unused within the period recommended by the manufacturer.
- 368.This entry does not include wood treated with wood-preserving chemicals.
- 369.'Out-dated' means unused within the period recommended by the manufacturer.
- 370.Note that even where low level contamination with Annex I materials initially exists, subsequent processes, including recycling processes, may result in separated fractions containing significantly enhanced concentrations of those Annex I materials.
- 371.The status of zinc ash is currently under review and there is a recommendation with United Nations Conference on Trade and Development (UNCTAD) that zinc ashes should not be dangerous goods.
- 372.This entry does not include scrap from electrical power generation.
- 373.Re-use can include repair, refurbishment or upgrading, but not major reassembly.
- 374.In some countries these materials destined for direct re-use are not considered wastes.
- 375.It is understood that such scraps are completely polymerized.
- 376.- Post-consumer wastes are excluded from this entry
- 377.When identifying a waste in the list below, the introduction to the Annex of Commission Decision 2000/532/EC as amended is relevant.
- 378.For the purpose of this list of wastes, PCBs will be defined as in Directive 96/59/EC
- 379.hazardous components from electrical and electronic equipment may include accumulators and batteries mentioned in 16 06 and marked as hazardous; mercury switches, glass from cathode ray tubes and other activated glass etc.
- 380.For the purpose of this entry, transition metals are: Scandium, Vanadium, Manganese, Cobalt, Copper, Yttrium, Niobium, Hafnium, Tungsten, Titanium, Chromium, Iron, Nickel, Zinc, Zirconium, Molybdenum and Tantalum. These metals or their compounds are dangerous if they are classified as dangerous substances. The classification of dangerous substances shall determine which among those transition metals and which transition metal compounds are hazardous.
- 381.Stabilisation processes change the dangerousness of the constituents in the waste and thus transform hazardous waste into non hazardous waste. Solidification processes only change the physical state of the waste (e.g. liquid into solid) by using additives without changing the chemical properties of the waste.
- 382.A waste is considered as partly stabilised if after the stalibisation process dangerous constituents which have not been changed completely into non dangerous constituents could be released into the environment in short, middle or long term.
- 383.Hazardous components from electrical and electronic equipment may include accumulators and batteries mentioned in 16 06 and marked as hazardous; mercury switches, glass from cathode ray tubes and other activated glass etc.

- 392.This legally binding act of the European Union is directly applicable in all member states of the European Union. The regulation is similar to national legislation in terms of the impact and direct effect it generates. As such the regulation is the most pervasive of all the legal instruments of the EU.
