on the conclusion of the Agreement between the European Economic Community and the Kingdom of Sweden extending and amending the Cooperation Agreement on a European research and development programme in the field of the recycling of urban and industrial waste

COMMUNICATION FROM THE COMMISSION TO THE COUNCIL

SUBJECT : Proposal for a Council Decision on the conclusion of an Agreement between the European Economic Community and the Kingdom of Sweden extending and amending the Cooperation Agreement on a European research and development programme in the field of the recycling of urban and industrial waste

A multi-annual research and development programme (1979 to 1983) in the field of the recycling of urban and industrial waste (secondary raw materials) was adopted by the Council on 12 November 1979 i.

A Cooperation Agreement between the European Economic Community and the Kingdom of Sweden aiming at associating this country with the above mentioned Community programme was signed by the two parties on 16 June 1982 and entered into force on 1 July 1982. This Agreement will expire on 31 October 1983.

By its decision 82/402/EEC of 17 May 1982 (2) the Council adopted a research and development programme (1982 to 1985) in the raw material sector, which includes the current programme in the field of the recycling oj- urban and industrial waste. A draft decision modifying the Decision 82/402/EEC and implying the continuation until 31 December 1985 of the research and development programme in the field of the recycling of urban and industrial waste as a part of the sub-programme in the field of recycling of the non-ferrous metals has just been presented to the Council for adoption (3).

Since the contracting parties, namely the Community and the Kingdom of Sweden, have a common interest in continuing their cooperation in the field of the recycling of urban and industrial waste, it is desirable that the above mentioned Cooperation Agreement be renewed for the period from 1 November 1983 to 31 December 1985.

As provided for in Article 7 (2) of Decision 82/402/EEC, the Commission has negotiated the said renewal with Sweden. The negotiations have led to the following results :

- the Cooperation Agreement on a European research and development programme

in the field of the recycling of urban and industrial waste will consequently be amended;

- the financial contribution of the Parties to the Agreement will be :

- 2.500.000 ECU by the Community. This amount constitutes the part of the total budget of 6.5 M ECU allocated to the sub-programme on the recycling of non-ferrous metals and of urban and industrial waste that the Commission intends to devote to the implementation of the research dealing with the recycling of urban and industrial waste.

- 105.000 ECU by Sweden. This amount is calculated in accordance

with the method of calculation applied in the previous Cooperation Agreement, i.e. by applying to the Community contribution the ratio between the gross domestic product of the Community and of Sweden for 1980. ■

The Commission hereby requests the Council to adopt the attached draft decision.

DRAFT COUNCIL DECISION

ON THE CONCLUSION OF THE AGREEMENT BETWEEN THE EUROPEAN ECONOMIC COMMUNITY AND THE KINGDOM OF SWEDEN EXTENDING AND AMENDING THE COOPERATION AGREEMENT ON A EUROPEAN RESEARCH AND DEVELOPMENT PROGRAMME IN THE FIELD OF THE RECYCLING OF URBAN AND INDUSTRIAL WASTE

THE COUNCIL OF THE EUROPEAN COMMUNITIES,

Having regard to the Treaty establishing the European Economic Community,

Having regard to Council Decision 82/402/EEC of 17 May 1982 adopting a research and development programme (1982 to 1985) in the raw material sector

(1), as amended by Decision 83/ /EEC (2),

and in particular Article 7 thereof.

Having regard to Council Decision 82/403/EEC of 25 May 1982 on the Conclusion of a Cooperation Agreement between the European Economic Community and the Kingdom of Sweden on a European research and development programme in the field of the recycling of urban and industrial waste (3),

Having regard to the Draft Decision submitted by the Commission,

Whereas in accordance with Article 7 (2) of Decision 82/402/EEC the Commission has negociated an Agreement with Sweden amending and extending the Cooperation Agreement on a European research and development programme in the field of the recycling of urban and industrial waste;

Whereas this Agreement should be approved,

Article 1

The Agreement between the European Economic Community and the Kingdom of Sweden extending and amending the Cooperation Agreement on a European research and development programme in the field of the recycling of urban and industrial waste is hereby approved on behalf of the Community.

The text of the Agreement is annexed to this Decision.

Article 2

The President of the Council is hereby authorized to designate the persons empowered to sign the Agreement in order to bind the Community.

DRAFT AGREEMENT

BETWEEN THE EUROPEAN ECONOMIC COMMUNITY AND THE KINGDOM OF SWEDEN EXTENDING AND AMENDING THE COOPERATION AGREEMENT ON A EUROPEAN RESEARCH AND DEVELOPMENT PROGRAMME IN THE FIELD OF THE RECYCLING OF URBAN AND INDUSTRIAL WASTE.

THE EUROPEAN ECONOMIC COMMUNITY, hereinafter referred to as 'the Community', and

THE GOVERNMENT OF THE KINGDOM OF SWEDEN, hereinafter referred to as 'Sweden'

Whereas the Co-operation Agreement between the Community and Sweden on a European research and development programme in the field of the recycling of urban and industrial waste, hereinafter referred to as 'the Agreement', signed on 16 June 1982, will expire on 31 October 1983;

Whereas, by its Decision of 17 May 1982, the Council of the European Communities adopted a research and development programme (1982 to 1985) in the raw materials sector, which included the ongoing Community programme in the field of the recycling of urban and industrial waste;

Whereas by its Decision of , modifying its

Decision of 17 May 1982, the Council of the European Communities decided to continue the last mentioned programme as part of the sub-programme of the said programme in the raw materials sector; "Recycling of non-ferrous metals and of urban and industrial waste";

Whereas the Community and Sweden expect to derive mutual benefit of a continuation of the research and development work carried out under the Agreement;

Whereas the Agreement necessitates supplementary contributions from the contracting parties

HAVE AGREED AS FOLLOWS :

Article 1

The Agreement shall be extended for the period 1 November 1983 to 31 December 1985.

Article 2

The Agreement is hereby amended as follows:

The Appendix to Annex C shall be replaced by the Appendix to this Agreement.

Article 3

The estimated maximum financial contribution by the Contracting Parties to the implementation of the European programme for the period 1 November 1983 to 31 December 1985 shall be 2 605 000 ECU to be divided as follows:

- 2.500.000 ECU from the Community

- 105.000 ECU from Sweden

The ECU is defined in the Financial Regulation applicable to the general budget of the European Communities and in the financial previsions adopted pursuant to that Regulation

Article 4

1. This Agreement shall enter into force on 1 November 1983.

2. It shall apply, on the one hand, to the territories

in which the Treaty establishing the European Economic Community is applied and under the conditions laid down in that Treaty and, on the other hand, to the territory of the Kingdom of Sweden.

Article 5

This Agreement, drawn up in a single original in the Danish, Dutch, English, French, German, Greek and Italian languages, each text being equally authentic, shall be deposited in the archives of the General Secretariat of the Council of the European Communities, which shall transmit a certified copy to each of the contracting parties .
