As a result, the weighting for Italy was increased by 6.4% by Council Regulations No 3084/78 of 21.12.1978^ and No 3087/78 of 21.12.1978^ and backdated to 1 January 1978.
A group of staff working in Ispra appealed, under the conditions laid down by Articles 90 and 91 of the Staff Regulations, against their salary statements for January 1979 which were calculated on the basis of the above regulations. They argued that the new weighting applicable from 1 January 1978 should have been backdated to 1 January 1976 since it was based on a statistical survey conducted at the end of 1975.
They further argued that a statistical weighting should have been fixed for staff in Varese to take account of living conditions in the area.
On the backdating issue, the Court found as follows:
"The Statistical Office's reports dated 17 and 29 June 1976 and its memorandum dated 17 August 1976 show that the cost of living in Rome and, to a greater extent in Varese, increased by some 2% more than in Brussels in 1976."

The Court referred to its judgment of 6 October 1982 (Case 59/81 -Commission v Council) in which it declared that the Council's role in adjusting the weightings was to determine whether there had been a considerable increase or not and, if so, to act accordingly.
On the second point, i.e. the fixing of a separate weighting for Ispra, the Court found in favour of the applicants:
"39. Under those conditions, in order that the rule contained in Article 64 of the Staff Regulations to the effect that account must be taken of living conditions in the various 'places of employment' may be observed, that expression must be understood as meaning not only the capitals of the Member States but the exact places where the duties of a sufficiently large number of officials and other employees of the Communities are performed.
40. Therefore it is for the Community institutions, in cases in which the cost of living in such a place of employment undergoes fluctuations greater than those occurring in the capital of the State in question, to determine separate weightings. Hence the applicant's submission relating to the calculation of the weighting affecting his salary on the basis of the cost of living in the province of Varese must be considered well founded."
The Commission is of the opinion that the weightings that the judgments referred to hold to be incorrectly established be repealed.
As to the backdating issue, the Commission considers that the 6.4% increase in the weighting applicable to the salaries and pensions of officials and other servants in Italy, set out in Regulations Nos 3084/78 and 3087/78, should be backdated to 1 January 1976.
As to the establishment of a separate weighting for Varese, the Commission has adopted the statistical method recommended by the Statistical Office of the European Communities and explained in the attached technical report. An ad hoc survey of living conditions in
Varese and Rome would not give satisfactory results for previous years.
However, the Commission plans to undertake such a survey in future.
It is proposed that separate weightings be fixed for Varese from 1 January 1976 onwards, since the weightings fixed prior to that date have not been disputed.
The attached proposal for a Regulation complies with the Court's judgments as far as regulations laying down weightings from 1 January 1976 to 1 July 1982 are concerned. The amendments to be made to the proposal for a regulation submitted under Article 65(2)

soon as the Statistical Office of the European Communities is in a position to produce a time index for Varese.

Memorandum on the Court's Judgment of 15 December 1982
- Action to be taken following the Court's Judgment of
15 December 1982 on the weighting applicable to the remuneration of staff serving in Italy.
- Statistical aspects of the problem.
1. Following the Court's Judgment, the 6.4% increase in the weighting for Italy (Rome and Varese) approved by the Council with effect from 1 January 1978 must be backdated to 1 January 1976.
This means that the weighting in force on 1 January 1976 must be multiplied by a factor of 106.4. After that date and up to 1 July 1977, the weightings must be multiplied by the same factor. For Rome, therefore, the weighting applicable on 1 January 1978 and subsequent weightings are correct.

2. For Varese there are two problems:
The first is to establish the difference in price levels between Rome and Varese on 1 January 1976; the second is to build an index for the Ispra area.
Annex I describes the procedure used to establish the difference in price levels.
Annex II describes the method used by the Office to calculate a specific index for Ispra (Annex II and Table 2).
Finally, Table 3 shows the corrections to be made for Varese from 1 January 1976 to 1 July 1982 to take account of the Court's decision.

III. The difference in price levels between Rome and Varese on 1 January 1976 can therefore be estimated at 4.4% - 1.8% = 2.6%.
In accordance with a Council Decision of 1968 the weightings applicable in the different countries are those of the capitals. The Court Judgment in Case 543/79 of 15 December 1982 states:
"39. Under those conditions, in order that the rule contained in Article 64 of the Staff Regulations to the effect that account must be taken of living conditions in the various 'places of employment' may be observed, that expression must be understood as meaning not only the capitals of the Member States but the exact places where the duties of a sufficiently large number of officials and other employees of the Communities are performed.
40. Therefore it is for the Community institutions, in cases in which the cost of living in such a place of employment undergoes fluctuations greater than those occurring in the capital of the State in question, to determine separate weightings." The Office has thus attempted to calculate a specific index for Varese. For technical reasons it has not been possible to calculate a genuine 'joint index', i.e. an index calculated on the basis of a weighting specific to Community officials^, for the period from 1 January 1976 to 1 July 1982.
To offset this drawback the Office has based its calculations on increases in ISTAT regional indexes for Rome and Varese and the increase in the joint index for Rome. The latter 'internationalizes' the Varese regional index by indirect application of an "international officials" weighting.
The results of employing this method are shown in Table 2.
An index of this kind will be calculated from 1 July 1982 in collaboration with ISTAT.

Report
by the Statistical Office of the European Communities on the establishment of purchasing power parities for European civil servants (geographical indexes)
asked by the ECSC High Authority, the EEC Commission and the
EAEC Commission to compare price levels in the different places
of employment of European civil servants with a view to
establishing the geographical inde;.?s provided for by Article 64

of the Staff Regulations .
This report: ,
- gives a brief outline of the technicalities of the survey;
- describes the conduct of the survey, which was run by the Statistical Office over the period March/May 1967 in conjunction with representatives of the national statistical services of the Member States and the OECD interorganization section for the study of salaries and prices;
- presents the findings of the survey.
The methodology and the technicalities of the survey were finalized at a meeting of the ad hoc Working Party on the 1967 price survey - European civil servants held in Brussels on 19 and 20 September 1966 under the chairmanship of the SOEC.

Although, in theory, a geographical index should have been established for each place of employment this proved impossible in practice because these places of employment are so widely dispersed.
It was therefore decided to limit the survey to the capitals of the Six and places of employment with a large number of officials, vi z:
Federal Republic of Germany: Bonn and Karlsruhe France: Paris, Paris region and Cadarache region Italy: Rome and Ispra region Netherlands: The Hague and Petten region Belgium: Brussels Luxembourg: Luxembourg.

For practical purposes three Lists of items were established:
- List I, containing 34 items priced directly in local shops by SOEC staff in conjunction with national experts.
- List II, containing 48 items priced directly by the national statistical institutes.
- List III, containing 161 items priced from the retail price survey undertaken by the SOEC in April and October each year, in conjunction with the national statistical institutes, in
a number of major cities in each country.
based on previous work by the SOEC in this area:
(a) for the selection of products and services, the list used was that already employed in 1963 for the household budgets survey carried out by the Office in 1965/66 among European civil servants employed in Brussels, Luxembourg and Ispra;
(b) for the descriptions, the definitions and standards used were those adopted by statisticians for the retail price survey.
Practical organization of the survey and the choice of shops were left to the national statistical institutes. To ensure comparability from one country to another the shops were chosen jointly in Brussels and Luxembourg by experts from the six countries. Department stores, supermarkets and specialist retail outlets were chosen; discount stores, luxury goods shops and markets were systematically left out.
For items on Lists I and II five prices were recorded, unless of course there was a single national price. For the Ispra region and for food items only, the number of prices was increased to seven. For items on List III all prices recorded during the survey were taken into account.
For items on Lists II and III the prices for all places of employment relate to April 1967.
Items on List I had to be priced between March and May 1967. Since these items are not subject to seasonal variations this slight, inevitable time lag had no influence on the findings.
Price ratios between the different places of employment and the provisional headquarters were calculated by using the Irving-Fisher formula. This formula is also used by the OECD and the United Nations.
Calculations for Brussels, Luxembourg and Ispra were based on the weightings determined by the household budgets survey (European civil servants) conducted by the Office in 1965/66. The latest OECD weightings were used for the other places of employment.
Given its importance in the household budget, it was decided to include rent in the calculation of geographical indexes.
The findings of the annual survey conducted by the SOEC among European civil servants were used for all places of employment except Rome, Paris, the Paris region and The Hague.
For Rome, Paris, the Paris region and The Hague, where very few European civil servants are employed, similar surveys conducted by the OECD were used.

of shops, pricing). In addition, an official from the
Belgian Ministry of Economic Affcirs and Energy and an
official from STATEC (Luxembourg Latistical Service) helped
with the survey at all places of employment side by side with
SOEC and OECD experts. At the end of the field survey in
each country, the prices recorded were critically examined.

It goes without saying that only prices approved by the entire ad hoc Working Party were used for the final calculations.

10. The final calculations and the resultant geographical indexes were examined and approved by the ad hoc Working Party at a meeting held in Luxembourg on 1 December 1967. The results shown below and the record of the meeting is attached.

Summary record of the meeting of the ad hoc Working Party on the 1967 price survey - European civil servants held in Luxembourg on 1 December 1967
1. The meeting was chaired by Mr Gavanier, Director for Social Statistics at the Statistical Office of the European Communities. The attendance list is shown in Annex II.
2. The Working Party examined the final results of the survey carried out by the SOEC in April 1967 at the request of the administrations of the institutions to serve as a basis for fixing the weightings provided for in Article 64 of the Staff Regulations of Officials of the European Communities.
3. The technicalities of the survey had been jointly approved by the statisticians of the six member countries of the Community at a meeting
held in Brussels on 19 and 20 September 1966, in the presence of representatives of the OECD interorganization section for the study of salaries and prices on behalf of the coordinated organizations.
4. The survey was carried out by SOEC staff with the direct participation of representatives of national statistical institutes of the six Community countries and representatives of the OECD interorganization section.
5. The data collected were submitted to expert statisticians from the six Community countries and approved by them.
6. The geographical indexes shown in Annex I, which include rent, were calculated by the Fisher method, which is also used by the United Nations and the coordinated organizations.
7. Statisticians from the six Community countries approved the price ratios between their countries and Brussels and between their countries and the Brussels/Luxembourg average.
8. This record was adopted at the meeting.

Having regard to the Treaty establishing a Single Council and a single Commission of the European Communities,
Having regard to the Protocol on the Privileges and Immunities of the European Communities, and in particular Article 13 thereof.

Having regard to the proposal from the Commission,
Whereas a large number of officials and other servants employed at the Joint Research Centre in Ispra instituted proceedings to secure replacement of their salary statements for January 1979;
Whereas, by judgment dated 15 December 1982, the Court ruled as follows:
The applicant's salary statement for January 1979 is annulled, in as far as it is restricted to giving effect to Council Regulation No 3087/78, both as to the amount of the adjustment of the weighting and as to the retroactive effect of that adjustment, together with the decisions rejecting the applicant's complaints; Regulation No 3087/78 is declared not applicable to the applicant in so far as it takes no account of the cost of living in Varese and limits the retroactive effect of the adjustment of the weighting to 1 January 1978.
