Point 28 of the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management[1] allows for the mobilisation of the European Globalisation Adjustment Fund (EGF) through a flexibility mechanism, within the annual ceiling of EUR 500 million over and above the relevant headings of the financial framework.

The rules applicable to the contributions from the EGF are laid down in Regulation (EC) No 1927/2006 of the European Parliament and of the Council of 20 December 2006 on establishing the European Globalisation Adjustment Fund[2].

On 7 February 2011, Italy submitted application EGF/2011/002 IT/Trentino-Alto Adige/Südtirol Construction of buildings for a financial contribution from the EGF, following redundancies in 323 enterprises operating in the NACE Revision 2 Division 41 ('Construction of buildings')[3] in the NUTS II region of Trentino-AltoAdige/Südtirol (ITD1 and ITD2 i) in Italy.

After a thorough examination of this application, the Commission has concluded in accordance with Article 10 of Regulation (EC) No 1927/2006 that the conditions for a financial contribution under this Regulation are met.

1. The application was presented to the Commission on 7 February 2011 and supplemented by additional information up to 6 July 2011.

2. The application meets the conditions for deploying the EGF as set out in Article 2(b) of Regulation (EC) No 1927/2006, and was submitted within the deadline of 10 weeks referred to in Article 5 of that Regulation.

Link between the redundancies and major structural changes in world trade patterns due to globalisation or the global financial and economic crisis


3. In order to establish the link between the redundancies and the global financial and economic crisis, Italy argues that the construction sector has been severely affected by the crisis. Loans to the construction sector or to individuals have been drastically reduced and the demand for new houses decreased due to declining consumer confidence and the lack of cash.

4. The Commission recognised in its Economic Recovery Plan[6] that the construction industry in the EU has seen demand plummet as a result of the crisis. Available data confirms the significant downturn in the construction sector, which fell in the EU-27 for seven consecutive quarters (Q1/2009 to Q3/2010) compared with the same period of previous year, mainly due to the decrease in private investment in the residential sector. The construction output in Italy has been following the same trend:

5. In its assessment of application EGF/2009/017 LT/Construction of buildings[7] the Commission has already stated the impact of the economic and financial crisis on the enterprises operating in the NACE Revision 2 Division 41 ('Construction of buildings').

Demonstration of the number of redundancies and compliance with the criteria of Article 2(b)


6. Italy submitted this application under the intervention criteria of Article 2(b) of Regulation (EC) No 1927/2006, which requires at least 500 redundancies over a nine-month period in enterprises operating in the same NACE Revision 2 Division in one region or two contiguous regions at NUTS II level in a Member State.

The application cites 643 redundancies in 323 enterprises operating in the NACE Revision 2 Division 41 ('Construction of buildings')[8] in the NUTS II region of Trentino-Alto Adige/Südtirol (ITD1 and ITD2) during the nine-month reference period from 1 March 2010 to 1 December 2010. All of these redundancies were calculated in accordance with the second indent of the second paragraph of Article 2 of Regulation (EC) No 1927/2006.

Explanation of the unforeseen nature of those redundancies


8. The Italian authorities argue that the financial and economic crisis has led to a sudden collapse of the world economy with an enormous impact on many sectors. The nature of the recession as far as the construction sector is concerned, with a sudden tightening of conditions for access to financial credit and a dramatic slowdown in new orders was unprecedented in recent times. Moreover since 2008 the economic situation has not been following the trends of previous years. The redundancies in the construction industry could not, therefore, have been foreseen or easily prevented.

In accordance with Article 7 of Regulation (EC) No 1927/2006, Italy has confirmed that a policy of equality between women and men as well as non-discrimination has been applied, and will continue to apply, during the various stages of the implementation of and, in particular, in access to the EGF.

Description of the territory concerned and its authorities and stakeholders


14. The territory concerned by the redundancies is the region of Trentino-Alto Adige/Südtirol. At NUTS II level it consists of two autonomous provinces: Trento and Bolzano/Bozen. The region is bordered by Austria to the north, by Switzerland to the north-west and by the Italian regions of Lombardy and Veneto to the west and south, respectively. It covers 13 607 km² and it is extremely mountainous, covering a large part of the Dolomites and the southern Alps. Trentino-Alto Adige/Südtirol has a population of about 1 017 000 people (498 000 in the Province of Bolzano/Bozen and 519 000 in the Province of Trento). The population density in the region (74,7 inhabitants per km²) is low if compared either to Italy or to the EU average (198,8 and 112 inhabitants per km² respectively). The Italian national institute of statistics ISTAT estimated that 70 834 foreign-born immigrants live in Trentino-Alto Adige/Südtirol, equal to 6,9 % of the total regional population. The service sector accounts for 69 % of total employment while industry represents 25 % of the jobs and the primary sector 5 %.

The main authorities concerned are the Agenzia di Lavoro della Provincia Autonoma di Trento (the Labour Agency of the Autonomous Province of Trento), the Provincia Autonoma di Bolzano/Bozen - Ufficio Politique del Lavoro a Finanziamento Europeo (the Autonomous Province of Bolzano-Bozen), Rete dei Centri per l'impiego della Provincia Autonoma di Trento e della Provincia di Bolzano/Bozen (network of employment centres in both provinces), the trade unions: Confederazione Generale Italiana del Lavoro –CGIL– del Trentino; Confederazione Italiana Sindacati dei Lavoratori –CISL– del Trentino; Unione Italiana del Lavoro –UIL– del Trentino, Südtiroler Gewerkschaftsbund, CISL dell'Alto Adige and UIL dell'Alto Adige; the employer organisations: Associazione Artigiani e Piccole Imprese (CONFARTIGIANATO); Associazione degli Industriali della Provincia di Trento (CONFINDUSTRIA); Unione Commercio e Turismo e Attivitá di Servizio del Trentino, Associazione per l'Artigianato –APA– di Bolzano, Associazione degli Industriali della Provincia di Bolzano (CONFINDUSTRIA) and Südtiroler Bauerbund.

Expected impact of the redundancies as regards local, regional or national employment


16. The economic situation of both provinces deteriorated in 2009 and their economic growth was negative (-3,0 % in Trento and -2,6 % in Bolzano/Bozen) compared with the previous year. Unemployment in Trento increased by 117 % in 2010 compared with 2009. In Bolzano/Bozen unemployment rate in Q3/2010 was 43 % higher than in the same quarter of the previous year. Moreover 9,3 % of the redundancies that occurred in the province of Trento from March to December 2010 were workers made redundant in the construction sector. In the province of Bolzano/Bozen layoffs in the construction sector during the same period represent 11 % of total layoffs. In both provinces the construction sector is an important employer as it represents 8,6 % of the jobs in Trentino and 8 % in Bolzano/Bozen. It also contributes by 15 % to the regional GDP. For all these reasons Italy expects the impact of the redundancies to be locally significant.

11.

Co-ordinated package of personalised services to be funded and a breakdown of its estimated costs, including its complementarity with actions funded by the Structural Funds


17. The following types of measures are proposed, all of which combine to form a coordinated package of personalised services aimed at re-integrating the workers into the labour market:

– Welcome session, intake and registration: The first measure provided to all participants includes information on available services and training programmes and on skills and training requirements. It is also the opportunity for the workers willing to participate in the measures to formalize an agreement of participation and interest.

– One-to-one counselling and guidance: Workers will be offered counselling services at the beginning of their individual pathway of reinsertion into the labour market. However they can access the counselling services at any time upon request (i.e. when having difficulties making choices, when feeling their motivation decreasing or simply when in need for support). The counsellors will provide vocational guidance to the dismissed workers and will orient them towards specific job offers.

– Skills assessment and outplacement: This is intended to help workers to identify their own skills and the opportunities related to their own interests and to establish a realistic career plan. The measure, which involves intensive and personalized counselling, is structured as a pathway consisting of six stages in which the worker and the counsellor work out on an issue (e.g. opportunities, interests, analysis of the motivations and expectations, etc). Following these assessments, a summary paper is put together, setting out a summary of the worker's skills, his/her individual project and an action plan.

– General training and re-training: This measure aims to train workers in four competences defined as key competences in the Recommendation of the European Parliament and of the Council of 18 December 2006 on Key Competences for Lifelong Learning[9]: 1) Communication in the mother tongue; 2) Communication in foreign languages; 3) Mathematical competence and basic competences in science and technology; and 4) Digital competence. These courses combine classroom attendance and distance learning to avoid the syndrome of return to school desk. The participation in at least one of the courses which are part of this measure is mandatory for all participants in the program of EGF active labour market measures.

– Coaching: This aims to train workers in the four key competences for lifelong learning not included in the general training and retraining measure: 1) Learning to learn; 2) Social and civic competences; 3) Sense of initiative and entrepreneurship; and 4) Cultural awareness and expression. This training is structured in two individual sessions and four group sessions (team coaching) and it consists of a tandem of key competencies: learning to learn plus one of the three remaining key competences.

– Individual vocational training: This covers specific retraining needs of dismissed workers who wish to work in a different sector or a different function. The length of the training proposed ranges from 40 to 200 hours.

– Mentoring after reintegration into work: To prevent possible problems arising in the new jobs and to help the workers to consolidate their posts, mentors will guide the workers reintegrated into employment.

– Participation allowance: To cover the expenses incurred when participating in the measures, the workers will receive up to EUR 400 per month. The amount will be calculated either on a daily basis (EUR 20 per day) or be paid as a lump-sum.

– Subsistence allowance: The workers will receive for each day they participate in the EGF measures a subsistence allowance equivalent to one day of the Italian subsistence allowance 'indemnità di mobilità. .

18. The expenditure for implementing the EGF, which is included in the application in accordance with Article 3 of Regulation (EC) No 1927/2006, covers management and control activities as well as information and publicity.

19. The personalised services presented by the Italian authorities are active labour market measures within the eligible actions defined by Article 3 of Regulation (EC) No 1927/2006. The Italian authorities estimate the total costs of these services at EUR 5 744 000 and the expenditure for implementing the EGF at EUR 285 000 (4,7 % of the total amount). The total contribution requested from the EGF is EUR 3 918 850 (65 % of the total costs).

20. Italy confirms that the measures described above are complementary with actions funded by the Structural Funds and that all double financing will be prevented.

21. Italy started the personalised services to the affected workers included in the co-ordinated package proposed for co-financing to the EGF on 1 May 2011. This date therefore represents the beginning of the period of eligibility for any assistance that might be awarded from the EGF.

Procedures for consulting the social partners


22. The measures have been discussed at the board of the Agenzia di Lavoro della Provincia Autonoma di Trento (Employment Agency of the autonomous province of Trento) which includes the social partners as 1/3 of the board members are nominated by trade unions and another 1/3 by employers. In the autonomous province of Bolzano-Bozen the measures have been discussed at the Commissione Provinciale per il Fondo Sociale Europeo (Provincial Committee for the ESF). This committee also includes the social partners.

23. The Italian authorities confirmed that the requirements laid down in national and EU legislation concerning collective redundancies have been complied with.

16.

Information on actions that are mandatory by virtue of national law or pursuant to collective agreements


24. As regards the criteria contained in Article 6 of Regulation (EC) No 1927/2006, the Italian authorities in their application:

· confirmed that the financial contribution from the EGF does not replace measures which are the responsibility of companies by virtue of national law or collective agreements;

· demonstrated that the actions provide support for individual workers and are not to be used for restructuring companies or sectors;

· confirmed that the eligible actions referred to above do not receive assistance from other EU financial instruments.

17.

Management and control systems


25. Italy has notified the Commission that the financial contribution will be managed and controlled by the same bodies that manage and control the ESF. The Agenzia di Lavoro della Provincia Autonoma di Trento (the Labour Agency of the Autonomous Province of Trento) and the Provincia Autonoma di Bolzano/Bozen - Ufficio Politique del Lavoro a Finanziamento Europeo (the Autonomous Province of Bolzano-Bozen) will be the intermediate bodies for the managing authority.

18.

Financing


26. On the basis of the application from Italy, the proposed contribution from the EGF to the coordinated package of personalised services (including expenditure to implement EGF) is EUR 3 918 850, representing 65 % of the total cost. The Commission's proposed allocation under the Fund is based on the information made available by Italy.

27. Considering the maximum possible amount of a financial contribution from the EGF under Article 10(1) of Regulation (EC) No 1927/2006, as well as the scope for reallocating appropriations, the Commission proposes to mobilise the EGF for the total amount referred to above, to be allocated under heading 1a of the financial framework.

28. The proposed amount of financial contribution will leave more than 25 % of the maximum annual amount earmarked for the EGF available for allocations during the last four months of the year, as required by Article 12(6) of Regulation (EC) No 1927/2006.

29. By presenting this proposal to mobilise the EGF, the Commission initiates the simplified trialogue procedure, as required by Point 28 of the Interinstitutional Agreement of 17 May 2006, with a view to securing the agreement of the two arms of the budgetary authority on the need to use the EGF and the amount required. The Commission invites the first of the two arms of the budgetary authority that reaches agreement on the draft mobilisation proposal, at appropriate political level, to inform the other arm and the Commission of its intentions. In case of disagreement by either of the two arms of the budgetary authority, a formal trialogue meeting will be convened.

30. The Commission presents separately a transfer request in order to enter in the 2011 budget specific commitment and payment appropriations, as required in Point 28 of the Interinstitutional Agreement of 17 May 2006.

Source of payment appropriations


31. Amending budget 3/2011 increased EGF budget line 04.0501 by EUR 50 000 000 in payment appropriations. Appropriations from this budget line will be used to cover the amount of EUR 3 918 850 needed for the present application.

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to the Interinstitutional Agreement of 17 May 2006 between the European Parliament, the Council and the Commission on budgetary discipline and sound financial management[10], and in particular point 28 thereof,

Having regard to Regulation (EC) No 1927/2006 of the European Parliament and of the Council of 20 December 2006 establishing the European Globalisation Adjustment Fund[11], and in particular Article 12(3) thereof,

Having regard to the proposal from the European Commission[12],

Whereas:

The European Globalisation Adjustment Fund (EGF) was established to provide additional support for workers made redundant as a result of major structural changes in world trade patterns due to globalisation and to assist them with their reintegration into the labour market.

The scope of the EGF was broadened for applications submitted from 1 May 2009 to include support for workers made redundant as a direct result of the global financial and economic crisis.

The Interinstitutional Agreement of 17 May 2006 allows the mobilisation of the EGF within the annual ceiling of EUR 500 million.

Italy submitted an application to mobilise the EGF, in respect of redundancies in 323 enterprises operating in the NACE Revision 2 Division 41 ('Construction of buildings') in the NUTS II region of Trentino-Alto Adige/Südtirol (ITD1 and ITD2), on 7 February 2011 and supplemented it by additional information up to 6 July 2011. This application complies with the requirements for determining the financial contributions as laid down in Article 10 of Regulation (EC) No 1927/2006. The Commission, therefore, proposes to mobilise an amount of EUR 3 918 850.

The EGF should, therefore, be mobilised in order to provide a financial contribution for the application submitted by Italy.

For the general budget of the European Union for the financial year 2011, the European Globalisation Adjustment Fund (EGF) shall be mobilised to provide the sum of EUR 3 918 850 in commitment and payment appropriations.
