THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty establishing the European Community, and in particular Article 235 thereof,

Having regard to the proposal from the Commission,

Having regard to the opinion of the European Parliament,

Having regard to the opinion of the Economic and Social Committee,

Whereas the representatives of the governments of the Member States, meeting at Head of State and Government level, took a decision jointly on 29 October 1993 as to the location of the seats of certain bodies and departments of the European Communities and of Europol (1), whereas a declaration was adopted on that occasion, regarding the location of the seat of the European Centre for the Development of Vocational Training;

Whereas there is a need to ensure consistency at Community level as regards the management of the staff of the different decentralized bodies;

Whereas there is consequently a need to amend Council Regulation (EEC) No 337/75 (2), as last amended by Regulation (EEC) No 1946/93 (3) and to repeal Council Regulation (ECSC, EEC, Euratom) No 1859/76 of 29 June 1976 laying down the Conditions of Employment of Staff of the European Centre for the Development of Vocational Training (4), as last amended by Regulation (Euratom, ECSC, EEC) No 679/87 (5),

HAS ADOPTED THIS REGULATION:


Article 1

Regulation (EEC) No 337/75 is hereby amended as follows:

1. The third paragraph of Article 1 is replaced by the following text:

'The Centre shall be non-profit making. It shall have its seat in Thessaloniki`;

2. Article 13 is replaced by the following text:

'Article 13

The staff of the Centre shall be subject to the regulations and rules applicable to the officials and other servants of the European Communities.

The Centre shall exercise, in respect of its staff, the powers devolved to the appointing authority.

The Management Board shall, in agreement with the Commission, adopt the appropriate implementing rules.`


Article 2

Regulation (ECSC, EEC, Euratom) No 1859/76 is repealed.


Article 3

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Communities.


This Regulation shall be binding in its entirety and directly applicable in all Member States.
