Explanatory memorandum

1. Article 21 of the Act concerning the conditions of accession of the Hellenic Republic and the adjustments to the Treaties states that acts listed in Annex I to this Act shall be adapted as specified in that Ainex". This Annex does not mention Council Directive 79/869/EEC of 9 October 1979 concerning the methods of measurement and. frequencies of sampling and analysis of surface water intended for the abstraction of drinking water in the Member States(1). Article 11(2) of this Directive states that the Committee on Adaptation to Technical Progress set up by Article 10 of that Directive must act by a majority of 41 votes.    '

2. The qualified majority after the accession of the Hellenic Republic will be 45 votes and Directive 79/869/EEC must be modified to this effect. This is the intention of the Gorranission proposal, which is presented pursuant to Article 146 of the Act of Accession of the Hellenic Republic.

3. The Council is therefore asked to adopt the attached directive.

THE COUNCIL OF THE EUROPEAN COMMUNITIES/

Having regard to the Act of Accession of Greece, and in particular Article 146 thereof;

Having regard to the proposal from the Commission;

Whereas Article 11(2) of Council Directive 79/869/EEC should be adapted to take account of the accession of Greece,

HAS ADOPTED THIS DIRECTIVE    '    .

.    .    Article 1

In Article 11(2) of Directive 79/869/EEC, '41' is replaced by '45'.

Article 2

This Directive shall take effect on 1 January 1981.

Article 3

This Directive is addressed to the Member States.
